President of the Republic vetoes Organic Law of the National Assembly following unconstitutionality findings by the Constitutional Court

Praia, Apr 10 (Inforpress) – The President of the Republic vetoed on Thursday, the 9th, the parliamentary diploma approving the Organic Law of the National Assembly, following an opinion issued by the Constitutional Court (CC) declaring some of the provisions contained in the document unconstitutional.

According to official information, José Maria Neves decided to request a prior review of the constitutionality of specific provisions of the diploma, namely the rule contained in Article 4 of the Preambular Law and the provisions of Article 77 of the annex referred to in Article 1 of the same law, due to doubts regarding their compliance with the Constitution of the Republic, in particular Articles 262 and 42(2).

The presidential initiative is grounded in constitutional provisions, notably subparagraph (r) of paragraph 1 of Article 135 and subparagraph (a) of paragraph 1 of Article 278 of the Constitution, as well as in provisions of Law No. 56/VI/2005 of 28 February.

Meanwhile, sitting in plenary, the Constitutional Court unanimously ruled that the aforementioned provisions are unconstitutional for violating Articles 1, 262, 42(2) and 241(6) of the Constitution of the Republic.
