The President of the Republic has vetoed the decree on exceptional entry into the civil service following a ruling by the Constitutional Court

Praia, April 9 (Inforpress) - The President of the Republic, José Maria Neves, vetoed and returned to the National Assembly the decree authorizing exceptional entry into the ranks of the Public Administration, complying with the constitutional requirement following the decision of the Constitutional Court (TC).

According to a statement from the Presidency of the Republic, the position arose following the opinion of the Constitutional Court, which ruled on the unconstitutionality of the provisions contained in articles 1, 3, no. 1, and 9 of the decree, within the scope of a request for preventive review of constitutionality.

On March 25th, José Maria Neves requested a preventive review of the legislation under the applicable constitutional and legal provisions, and the Constitutional Court concluded that the regulations in question violate the principle of equality, the right of access to public office under equal conditions, as well as the principles of merit and justice.

In a letter sent to the President of the National Assembly, Austelino Correia, the Head of State cites the Constitutional Court’s ruling, which finds that the legislation establishes a mechanism for direct and permanent entry into the civil service without a public competitive examination, which is inconsistent with the Constitution.
