Praia, Sep 24 (Inforpress) – The Constitutional Court (TC) rejected appeals for constitutional protection and request for a ruling clarification brought by the applicant Alex Saab, who awaits the decision on extradition to the United States of America.
The same source points out that “it is evident” that the parts identified “do not have any ambiguity or obscurity”, which hold any doubts as to the authorship of the decision-making segment indicated by the applicant.
“The parts of the reasoning of the judgment identified by the applicant, according to which the Constitutional Court decides briefly for the dismissal of the question of unconstitutionality posed, is enlightening as to the entity that decided, and cannot give rise to the slightest doubt”, argues the TC in the document.
The same source adds that the application was rejected by judgment No 24/2021 of 10 March because it considered that “there was no ambiguity which resulted in obscurity that should be made clear”. The defence wanted the Constitutional Court to grant its client the provisional measure of immediate restitution to freedom, because the legal periods of detention for extradition and, consequently, the obligation to remain in housing were exhausted.
